1. Introduction These Terms of Service outline the replacement costs for loss or damage to items, including the cost of damage to the trailer, when renting or leasing our equipment or facilities. By renting or leasing our equipment or facilities, you agree to be bound by these Terms of Service.
2. Replacement Costs for Loss or Damage to Items In the event that any of our equipment or facilities are lost or damaged during your rental or lease, you agree to pay the full replacement cost of the items, as determined by us. The replacement cost includes the cost of the item itself, as well as any applicable taxes, fees, and shipping costs.
3. Cost of Damage to Trailer If you are renting or leasing a trailer from us and it is damaged during your use, you agree to pay for the cost of repairing or replacing the trailer. The cost of repairing or replacing the trailer will depend on the extent of the damage and the market value of the trailer at the time of the damage.
4. Reporting Loss or Damage You agree to report any loss or damage to our equipment or facilities, including any damage to the trailer, immediately upon discovery. Failure to report any loss or damage may result in additional fees or charges.
5. Payment of Replacement Costs You agree to pay the full replacement cost for any lost or damaged items, as well as the cost of repairing or replacing the trailer if damaged during your rental or lease.
6. Dispute Resolution In the event of a dispute regarding the replacement costs for loss or damage to items, including the cost of damage to the trailer, the matter shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
7. Limitation of Liability We are not liable for any damage caused by the use or misuse of our rental items. By renting or leasing our equipment or facilities, you assume all risks and responsibilities associated with the use of the rented items, including but not limited to, injury, loss or damage to property, and any other consequential or incidental damages. We strongly recommend that you familiarize yourself with the proper operation of the equipment and follow all safety instructions provided by us. Any damage caused by misuse or negligence of the rented items will be your sole responsibility and you agree to indemnify and hold us harmless from any claims, losses, damages, or expenses arising out of such use or misuse.
8. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of the state in which our facilities are located.
9. Modification of Terms We reserve the right to modify these Terms of Service at any time. Any modifications will be effective immediately upon posting on our website or other notice to you.
